So it looks as if the Brawl team at least tried to initiate contact with Sega. Though, this is an August 2006 statement, so whether Sega responded or not since then can still be anyone's guess.
That is exactly why he won't appear in SSB. He's too overpowered. All characters in the game are balanced in some way. If you add one overpowered character, everyone will want to be that character and it's not fair to the people not playing as him. And then you lose diversity because everyone will switch over to him.
