Well, since the 3D effects can be turned off at will, is it even necessary to include 3D effects? The 3DS has backwards capabilities to the regular DS, so I don't see why the 3D effects will be a problem. Homebrew, as DOOD said, most likely will be, but it was possible with the Wii.
